Photo credit: dominicacentral.comJustice Brian Cottle on Thursday granted an order to attorneys representing Prime Minister Roosevelt Skerrit to serve Dr. Thomson Fontaine with a claim form and statement of claim filed last year outside of Dominica. On 29th December, 2011 the legal team representing Prime Minister Roosevelt Skerrit filed a claim against Dr. Fontaine for defamation and malicious falsehood on the internet. It was reported by Dr. Fontaine that the Prime Minister had been involved in the sale of Dominican passports in circumstances which the Prime Minister considered to be false. When the claim form was filed, the attorneys representing the Prime Minister communicated with Dr. Fontaine via email requesting that he consents to service via email. That request was never replied to therefore a Court order was sought for service to be effected on him outside of Dominica, more specifically in the United States where he resides. The law requires that there must be personal service of a claim form and there must also be proof of service. The Court ordered on Thursday that “Leave be granted to the Claimant to serve out of jurisdiction the Claim Form and Statement of Claim on the First Defendant [Thomson Fontaine] at the following address: 9615 Kings Grant Road, Laurel MD, 20723 U.S.A or at such other place in the United States of America as he may be found”. The Order further states that “the Defendant is to file and serve an acknowledgment of service within 35 days of service of the Claim Form and the Statement of Claim and a defence within 56 days of service of the Claim Form and Statement of Claim”.
